Terms of Service
Power Junk & Bins Co. Ltd.
Effective Date: January 1, 2026
These Terms of Service (“Terms”) govern all services provided by Power Junk & Bins Co. Ltd. (“Power Junk”, “we”, “our”, or “us”). By requesting, scheduling, or receiving any service, you (“Customer”, “you”, or “your”) agree to be bound by these Terms in full.
Section 1 — General Terms
Apply to All Services
1.1 Estimates & Final Pricing
- All estimates are based on the information available at the time of quoting, including descriptions, photos, and access details provided by the customer.
- Final pricing may vary depending on actual volume, weight, material type, or site conditions discovered on arrival.
- Pricing is confirmed on-site before any work begins. No work will proceed without the customer’s verbal or written approval of the final price.
- Additional charges may apply for items not disclosed during the initial estimate.
1.2 Payment Terms
- Payment is due in full upon completion of services unless otherwise agreed in writing.
- We accept major credit cards, e-transfer, and other approved payment methods.
- All prices are quoted in Canadian Dollars (CAD) and are subject to applicable taxes.
- Outstanding balances may be subject to collection procedures if not resolved within 30 days.
1.3 Access & Safety
- The customer is responsible for providing safe, clear, and unrestricted access to the service area.
- Power Junk is not responsible for delays, cancellations, or additional charges caused by restricted access, unsafe conditions, or undisclosed obstacles.
- If our crew determines that a site poses a safety risk (e.g., unstable structures, hazardous conditions, unsecured animals), we reserve the right to pause or refuse service.
- The customer must disclose any known hazards, access limitations, or special conditions before work begins.
1.4 Property & Pre-Existing Conditions
- Power Junk & Bins Co. Ltd. is fully insured for general liability.
- We are not responsible for pre-existing property damage, hidden structural weaknesses, or damage resulting from undisclosed or concealed conditions.
- Any known concerns (cracked tiles, damaged walls, weak floors, aging structures) must be reported before work begins.
- If undisclosed conditions cause additional damage during the course of service, liability rests with the customer.
1.5 Prohibited & Restricted Materials
We do not handle hazardous or restricted materials including, but not limited to:
- Asbestos-containing materials
- Chemical waste, solvents, and paints
- Biohazard or medical waste
- Propane tanks and pressurized containers
- Fuel, oils, and automotive fluids
- Any materials restricted by Ontario environmental regulations
If prohibited materials are discovered during service, work may be stopped and the customer will be responsible for any additional costs incurred. If the customer knowingly includes hazardous materials without disclosure, they assume full liability.
1.6 Disposal & Donation Practices
- We prioritize responsible disposal and donate reusable items when appropriate.
- Final disposal methods (landfill, recycling, donation) are determined at our discretion based on material condition, facility availability, and Ontario regulations.
- Once items are loaded onto our vehicle, they are considered surrendered by the customer. We do not guarantee specific disposal outcomes for individual items.
1.7 Cancellations & Rescheduling
- Cancellations must be made with reasonable notice (minimum 24 hours recommended).
- Same-day cancellations or no-shows may be subject to a service fee to cover scheduling and travel costs.
- Rescheduling is available at no charge with at least 24 hours’ notice, subject to availability.
- Power Junk reserves the right to reschedule service due to weather, safety conditions, or operational circumstances. We will notify the customer as soon as possible.
1.8 Limitation of Liability
- Power Junk & Bins Co. Ltd. is not liable for indirect, incidental, or consequential damages arising from the use of our services.
- Total liability for any claim shall not exceed the amount paid by the customer for the specific service in question.
- Claims must be reported within 48 hours of service completion. After this period, claims may not be considered.
1.9 Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be resolved in the courts of Ontario.
1.10 Photography & Media Consent
By booking and receiving any service from Power Junk & Bins Co. Ltd., you authorize us to photograph and/or record video of the work area and completed job for the purposes of:
- Social media content (Instagram, Facebook, and similar platforms)
- Website portfolio and before/after galleries
- Marketing, advertising, and promotional materials
- Internal training and quality documentation
All photographs and recordings will focus on the work performed (e.g., before/after of junk removal, demolition progress, bin rental placement). We will not capture identifiable personal information, faces, or private documents without separate consent.
If you prefer that no photographs or recordings be taken at your property, you must notify us in writing before the start of service. Opting out does not affect your service agreement or pricing in any way.
Section 2 — Service-Specific Terms
Additional terms that apply to each service
2A. Junk Removal
- Pricing is based on the volume of space occupied in the truck, not the number of items.
- The customer must clearly identify all items to be removed before loading begins.
- We are not responsible for items loaded by mistake unless the customer notifies us before we leave the property.
- Heavy items (e.g., hot tubs, pianos, safes, concrete) may require additional labor charges due to weight, access difficulty, or safety considerations.
- Curbside pickups may qualify for a reduced rate. Discounts are confirmed at the time of booking.
- Items located in confined spaces (basements, crawl spaces, attics) may require additional handling charges.
2B. Bin Rentals (Dump Trailer)
- Rental period, delivery, and pickup schedule will be agreed upon at the time of booking.
- The customer is responsible for placing the bin/trailer on their own property (typically the driveway) and ensuring adequate space for delivery and pickup access.
- Overloading the bin beyond the marked fill line or weight limit may result in additional dump fees or a requirement to remove excess material before pickup.
- Protective boards are provided to help protect driveway surfaces. However, Power Junk is not liable for cosmetic wear on driveways, lawns, or surfaces caused during standard delivery and pickup operations.
- The customer is responsible for any municipal permits required for bin placement on public property (e.g., roadside). Power Junk operates on private driveways only by default.
- Prohibited materials must not be placed in the bin. Contamination with hazardous or restricted materials may result in additional disposal charges and/or service refusal.
- Rental extensions are available and must be requested before the scheduled pickup date. Extended rental fees apply.
2C. Small Demolition
- Small demolition services include removal of non-structural interior or exterior elements such as decks, sheds, fencing, flooring, drywall, cabinetry, and similar items.
- We do not perform structural demolition (load-bearing walls, foundations, roofing systems) or work requiring engineering assessments or municipal building permits.
- The customer must confirm ownership or authorization to demolish/remove the specified items.
- Hidden conditions (e.g., mold, asbestos behind walls, electrical or plumbing behind panels) discovered during demolition may result in work being paused. The customer is responsible for remediation of concealed hazards.
- Dust, debris, and noise are inherent to demolition work. We take reasonable precautions but are not liable for unavoidable dust migration or temporary disruption.
- Disconnection of utilities (electrical, gas, plumbing) must be completed by the customer or a licensed professional before demolition begins. Power Junk does not disconnect or modify any utility connections.
- Debris removal is included unless otherwise stated. Any material the customer wishes to keep must be identified before work starts.
Section 3 — Acceptance
Acknowledgment
By booking, scheduling, or receiving any service from Power Junk & Bins Co. Ltd., you acknowledge that you have read, understood, and agree to these Terms of Service in their entirety.
We reserve the right to update or modify these Terms at any time. The effective date at the top of this page reflects the most recent revision. Continued use of our services constitutes acceptance of any changes.
